19. Mai 2020 - TCI Fund Management Limited ("TCI") hat heute Strafanzeige gegen Verantwortliche der Wirecard AG ("Wirecard"; ISIN DE0007472060) bei der Staatsanwaltschaft München I erstattet. Hintergrund hierfür ist, dass sich nach der Einschätzung von TCI aus dem von Wirecard am 28. April 2020 veröffentlichten KPMG-Bericht sowie aus öffentlicher Berichterstattung, unter anderem der Financial Times und der WirtschaftsWoche, Auffälligkeiten ergeben, die möglicherweise strafrechtlich relevant sind. Dies betrifft den Kauf von Hermes I Tickets Pte. Ltd. in Indien, das sogenannte "Third-Party Acquiring-Geschäft" sowie die Vergabe von Krediten im Rahmen des sogenannten "Merchant Cash Advance-Geschäfts".

Von TCI verwaltete Fonds halten eine "Short-Position" auf die Aktie von Wirecard. Entsprechend den gesetzlichen Vorgaben hat TCI die Short-Position der zuständigen BaFin mitgeteilt und im Bundesanzeiger veröffentlicht. Zuletzt hat TCI am 29. April 2020 im Bundesanzeiger eine Netto-Leerverkaufsposition in Höhe von 1,53 % des ausgegebenen Aktienkapitals von Wirecard veröffentlicht und der BaFin gemeldet.
 

19 May 2020 - TCI Fund Management Limited ("TCI") has today filed a criminal complaint against responsible parties of Wirecard AG ("Wirecard"; ISIN DE0007472060) with the public prosecutor's office in Munich (München I). The background to this is that, in the view of TCI, the KPMG report published by Wirecard on 28 April 2020 as well as public reporting, including that in the Financial Times and WirtschaftsWoche, reveal anomalies that may have criminal relevance. This relates to the purchase of Hermes I Tickets Pte. Ltd. in India, the so-called "third-party acquiring business" as well as the granting of loans within the scope of the so-called "merchant cash advance business".

Funds managed by TCI hold a "short position" in Wirecard shares. In accordance with legal requirements, TCI has notified the short position to the relevant competent authority, BaFin, and published it in the Federal Gazette. Most recently, on 29 April 2020, TCI published a net short position of 1.53% of Wirecard's issued share capital in the Federal Gazette and reported it to BaFin.
