Munich Regional Court declares Wirecard's 2017 and 2018 balance sheets null and void - leading investor representatives see tailwind for damages litigation against EY.
Today's ruling by the Munich Regional Court declaring Wirecard AG's balance sheets for several years null and void is welcomed by leading investor representatives. Dr. Wolfgang Schirp of Schirp & Partner Rechtsanwälte mbB in Berlin, which represents the numerically strongest group of plaintiffs with more than 1,200 proceedings, says: "The ruling does bring disadvantages to the former Wirecard shareholders on the surface, because insolvency administrator Jaffé will try to reclaim past dividend payments to the assets on this basis. On the other hand, the ruling confirms massive misconduct by EY and thus provides tailwind for our lawsuits. Especially in view of the fact that litigation funding has been available for individual lawsuits for the first time since a month, we can expect the wave of lawsuits against EY to rise sharply."
